The Privacy Policy applies to our application, mobile application, website and any other Alana Kern Life features that collect information when users visit or use our application. The user is responsible for maintaining the confidentiality of their Alana Kern Life account, password, and all activities within the account. Alana Kern Life LLC reserves the right to refuse service to anyone.

 

Data Policy

Any data created, submitted, or uploaded to a user’s Alana Kern Life account, during the course of normal and regular use, represents User Data that remains the user’s property. User Data is stored and processed as part of our provided services governed by the Terms of Service and accepted by the account owner. Data Retention

We retain data for the lifetime of the user’s account, while providing the user the ability for full control over this data; This includes modification and permanent deletion of user data from the account and archival backups. Account owners may request all of their data be furnished to them in a timely and organized fashion. Please contact support for all data requests. This process requires verification and confirmation from the authorized account owner.

 

Permanent Data Deletion

Upon request of the account owner, we will process a full data purge from our active records and archival backups. Once this process is complete, we will be unable to reactivate the account or to furnish the user with account data. Contact support for all data deletion requests. 3rd Party Providers

Alana Kern Life may use data or data processing from 3rd party providers. Upon request we will provide a list of these providers with their corresponding domain website address and links to their Privacy/GDPR policies. We do not have control over data shared with 3rd party providers that has been exported or copied from our app or that the user has shared with 3rd parties outside of the Alana Kern Life LLC Terms of Service. Should there be such an occurrence, the responsibility is solely that of the user to remedy by contacting the 3rd party provider directly and request that user information be restricted or deleted.

CREATING AN ACCOUNT

Once you create an account with us, you are registered on the Alana Kern Life Site. The terms

"Member," "sponser," "sponsorship," "membership," and "account" all refer to this registration as a user on Alana Kern Life's Site. If you are merely surfing or browsing through the Site and have not yet created an account, your use of the Site is still subject to this Agreement; if you do not agree to this Agreement, do not use the Site. When you create an account, you will provide a unique username and email. We will also ask

you create a password. Because any activities that occur under your username or password

are your responsibility it is important for you to keep your username and/or password secure. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Alana Kern Life is not responsible for third party access to your account that results from theft or misappropriation of your account. Notify us immediately if you believe that

someone has used your username, email, or password without your authorization.

Furthermore, the registering party hereby acknowledges, understands and agrees to:

a) furnish factual, correct, current and complete information with regards to yourself as

may be requested by the data registration process, and

b) maintain and promptly update your registration and profile information in an effort to

maintain accuracy and completeness at all times.

If anyone knowingly provides any information of a false, untrue, inaccurate or incomplete nature,

Alana Kern Life LLC will have sufficient grounds and rights to suspend or terminate the member

in violation of this aspect of the Agreement, and as such refuse any and all current or future use

of Alana Kern Life LLC Services, or any portion thereof.

 

PROPRIETARY RIGHTS

You do hereby acknowledge and agree that Alana Kern Life LLC's Services and any essential

software that may be used in connection with our Services (" content ") shall contain proprietary

and confidential material that is protected by applicable intellectual property rights and other laws. Furthermore, you herein acknowledge and agree that any Content which may be contained in any advertisements or information presented by and through our Services or by advertisers is protected by copyrights, trademarks, patents or other proprietary rights and laws. Therefore, except for that which is expressly permitted by applicable law or as authorized by Alana Kern Life LLC or such applicable licensor, you agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or created any plagiaristic works which are based on Alana Kern Life LLC Services (e.g. Content or Software), in whole or part. Furthermore, you do herein agree not to alter or change the Content in any manner, nature or form, and as such, not to use any modified versions of the Software, including and without limitation, for the purpose of obtaining unauthorized access to our Services. Lastly, you also agree not to access or attempt to access our Services through any means other than through the interface which is provided by Alana Kern Life LLC for use in accessing our Services.

 

COMMERCIAL REUSE OF SERVICES

Users herein agrees not to replicate, duplicate, copy, trade, sell, resell nor exploit for any commercial reason any part, use of, or access to Alana Kern Life's sites.

 

Payment Terms

A valid credit card is required for use of Alana Kern Life on a month-to-month or annual basis. Alana Kern Life is billed in advance, on a monthly or annual basis, and is non-refundable. There will be no refunds or partial charges for partial months of service, or for months unused with an open account. All fees are exclusive of all taxes or duties imposed by governing authorities. The user is solely responsible for payment of all such taxes or duties.

 

Alana Kern Life processes all payment information through a secure payment system. Payment details are not stored on Alana Kern Life servers.

 

Security Policy

User payments and personal information are always safe. Our Secure Sockets Layer (SSL) software is the industry standard and among the best software available for secure commerce transactions. It encrypts all of the user’s personal information, including credit card number, name, and address, so that it cannot be read over the internet.

 

Modification of Fees and Services

Alana Kern Life LLC reserves the right to modify, suspend, or discontinue the use of Alana Kern Life for any reason without previous notice. Alana Kern Life LLC reserves the right to change fees upon 30 days notice from us.

 

Cancellation and Termination

The user is responsible for the cancellation of their account. A Alana Kern Life account can be cancelled at any time by clicking on the “Cancel Subscription” button in the “My Subscriptions” section. https://www.alanakernlife.com/account/my-subscriptions There will be no refund Alana Kern Life is cancelled before the end of the current, paid month/year, and there will be no charges thereafter. There is no cancellation fee. Cancellation is immediate and all of the user’s data will be deleted from Alana Kern Life upon cancellation. Alana Kern Life LLC may terminate a user’s account for any reason at any time.

 

Intellectual Property Rights

The user acknowledges that Alana Kern Life LLC owns all rights, title and interest in Alana Kern Life, including all intellectual property rights protected by U.S. and international intellectual property laws. The user agrees to not copy, alter, modify, or create derivative services from Alana Kern Life. The user also agrees to not use any robot, spider or other automated or manual devices to monitor or copy any content from Alana Kern Life. Alana Kern Life LLC claims no intellectual property rights over the content submitted to Alana Kern Life.

 

The user herein acknowledge, understand and agree that all of the Alana Kern Life LLC trademarks, copyright, trade name, service marks, and other Alana Kern Life LLC logos and any brand features, and/or product and service names are trademarks and as such, are and shall remain the property of Alana Kern Life LLC. You herein agree not to display and/or use in any manner the Alana Kern Life LLC logo, videos, photos, icons, or marks without obtaining Alana Kern Life LLC 's prior written consent. Alana Kern Life LLC will always respect the intellectual property of others, and we ask that all of our users do the same. With regards to appropriate circumstances and at its sole discretion, Alana Kern Life LLC may disable and/or terminate the accounts of any user who violates our Terms and/or infringes the rights of others. If you feel that your work has been duplicated in such a way that would constitute copyright infringement, or if you believe your intellectual property rights have been otherwise violated, you should provide to us the following information:

a) The electronic or the physical signature of the individual that is authorized on behalf of

the owner of the copyright or other intellectual property interest;

b) A description of the copyrighted work or other intellectual property that you believe has

been infringed upon;

c) A description of the location of the site which you allege has been infringing upon your

e) A statement, in which you state that the alleged and disputed use of your work is not

Warranties and Liability

Alana Kern Life LLC does not warrant that Alana Kern Life will: meet user requirements or expectations, that Alana Kern Life will be timely, uninterrupted or error-free nor operate in combination with other hardware or software, that bugs or errors will be corrected, or that mathematical calculations performed by Alana Kern Life are accurate. All conditions, representations, warranties are hereby disclaimed to the maximum extent permitted by applicable law. The user understands and agrees that Alana Kern Life LLC shall not be liable for any damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of Alana Kern Life.

 

Indemnification

Users of Alana Kern Life agree to hold harmless and indemnify Alana Kern Life LLC and its affiliates, agents, officers and employees from and against any 3rd party claim coming from or related to the use of Alana Kern Life, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees, of every kind. In such a case, Alana Kern Life LLC will provide the user with written notice of such claim, suit or action. The failure of Alana Kern Life LLC to exercise or enforce any right or provision of the Terms of Service does not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between Alana Kern Life LLC and the user and governs the use of Alana Kern Life superseding any prior agreements between Alana Kern Life LLC and the user.
